Terms and Conditions

1. Service Overview#

BharatBin is a technology-enabled platform connecting households, businesses, collection partners, recyclers, and waste processing partners for responsible collection and recycling of recyclable materials and regulated waste streams.

BharatBin facilitates booking, scheduling, digital records, payments, operational coordination, and compliance support. BharatBin does not own the waste unless expressly agreed in writing.

2. Customer Terms#

Customers agree to:

• Provide accurate booking information.
• Present recyclable materials honestly.
• Not offer prohibited or illegal materials.
• Allow safe access for collection.
• Use the Platform only for lawful purposes.

3. Collection Partner (Kabadiwala) Terms#

Independent Business

Collection Partners operate as independent businesses. They are not employees, agents or representatives of BharatBin.

Collection Responsibilities

• Collect assigned recyclable materials.
• Provide transparent weighing.
• Behave professionally with customers.
• Maintain accurate digital records.
• Follow BharatBin Standard Operating Procedures.

Existing Recycler / PRO Relationship

Where a Collection Partner collects regulated waste on behalf of an authorized recycler, collection centre or Producer Responsibility Organisation (PRO), the Collection Partner represents that:

• A valid commercial arrangement or Memorandum of Understanding (MoU) exists.
• The arrangement authorises collection of the relevant regulated waste.
• The arrangement shall remain valid while using BharatBin.
• BharatBin shall be notified immediately if the arrangement expires, terminates or changes materially.
• BharatBin may request supporting documents at any time.

Regulated Waste

Regulated waste shall only be transferred to verified downstream entities identified through BharatBin or under the Collection Partner's verified commercial arrangement.

4. Recycler & Collection Centre Terms#

Recyclers, dismantlers, refurbishers and collection centres using the Platform agree that:

• They possess all required registrations and authorizations applicable to their operations.
• Information submitted to BharatBin is accurate.
• They shall acknowledge receipt of regulated waste where applicable.
• They shall comply with all applicable environmental laws.
• BharatBin may verify authorizations periodically.

5. Payments#

Payments, commissions, incentives and settlement timelines shall be governed by BharatBin's commercial policies.

BharatBin reserves the right to withhold payments where fraud, investigations or legal obligations require such action.

6. Platform Responsibilities#

BharatBin provides:

• Technology infrastructure.
• Digital booking.
• Payment support.
• Operational coordination.
• Digital transaction records.

BharatBin does not assume ownership of waste or responsibility for independent business activities of Collection Partners or Recyclers unless expressly agreed.

7. Compliance with Environmental Laws#

Every user, Collection Partner and Recycler remains solely responsible for complying with all applicable environmental, municipal and statutory requirements.

BharatBin may verify documents and commercial arrangements but does not grant statutory authorization or regulatory approval.

8. Intellectual Property#

All BharatBin trademarks, logos, software, content and branding remain the exclusive property of BharatBin or its licensors.

9. Privacy#

Your use of the Platform is subject to the BharatBin Privacy Policy, which explains how personal information is collected and processed.

14. Limitation of Liability #

BharatBin provides a technology platform that helps users connect with independent Collection Partners for the responsible collection of e-waste.

BharatBin also promotes responsible e-waste management by:

• Providing educational information and awareness about responsible e-waste disposal.
• Connecting users with independent Collection Partners through its platform.
• Supporting digital booking, lead management and communication between users and Collection Partners.
• Encouraging environmentally responsible handling of e-waste in accordance with applicable laws.
• Maintaining platform standards through verification and review of participating Collection Partners where applicable.

However, BharatBin does not own, purchase, transport, dismantle, refurbish, recycle, or take possession of e-waste, and is not a party to transactions between users and Collection Partners.

Accordingly, BharatBin is not responsible for:

• The condition, ownership, quantity or quality of e-waste.
• Pricing decisions or commercial negotiations.
• Payments or payment disputes.
• Transportation, collection or delivery of e-waste.
• Environmental compliance by Collection Partners.
• The acts, omissions or representations of Collection Partners.
• Any dispute arising between users and Collection Partners.

11. Suspension & Termination#

BharatBin may suspend or terminate accounts where users or partners:

• Provide false information.
• Engage in fraudulent conduct.
• Violate applicable laws.
• Misuse the Platform.
• Transfer regulated waste through unauthorized channels.
• Breach these Terms.

12. Governing Law#

These Terms shall be governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts at Rajpura, Punjab.
